These applications were submitted by Nauru Ocean Resources Inc. (sponsored by the Republic of Nauru) and Tonga Offshore Mining Ltd. (sponsored by the Kingdom of Tonga).

1. The Republic of Nauru (the " State " ) and Nauru Ocean Resources Inc. (the " Contractor " ) have drafted an agreement that, inter alia:
