In his previous report to the General Assembly, the Special Rapporteur noted that in Myanmar violations of the freedom of association take two principal forms: restrictions on associations of a political nature, and the right to form and join independent trade unions.

CESCR was concerned that the Government prevented the formation of independent trade unions and that labour rights activists faced harassment, arrests and detention based on vaguely worded charges, such as " harming state security " , " acting against national security " or " spreading propaganda against the system " ; as well as that workers who participated in strikes faced reprisals from the authorities.
49- وأعربت اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية عن قلقها لمنع الحكومة إنشاء نقابات عمالية مستقلة ولما يتعرض له النشطاء في مجال حقوق العمال من مضايقات وتوقيف واحتجاز بتُهم مبهمة الصياغة، من قبيل " الإضرار بأمن الدولة " أو " العمل على زعزعة الأمن القومي " أو " نشر دعاية مناوئة للنظام " ، وكذلك لما يتعرض له العمال المشاركون في إضرابات من أعمالٍ انتقامية من جانب السلطات(93).
