Adopting a contextual and purposive interpretation of article 2 of the Covenant, the Human Rights Committee has confirmed that " a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " .
وأكدت اللجنة المعنية بحقوق الإنسان، باعتمادها تفسيراً سياقياً وهادفاً للمادة 2 من العهد، أن " على الدولة الطرف أن تحترم وتكفل الحقوق المنصوص عليها في العهد لأي شخص خاضع لسلطة تلك الدولة الطرف أو لسيطرتها الفعلية، حتى وإن لم يكن موجوداً داخل إقليمها " ().

In a similar vein, the Human Rights Committee, in its general comment No. 31, has stated that a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within its territory (CCPR/C/21/Rev.1/Add.13, para. 10).

This position was confirmed and further explained in the Committee's general comment No. 31, where the Committee clearly set out that " a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " (emphasis added).

The extra-territorial applicability was elaborated by the Human Rights Committee in its general comment 31: " A State party must respect and ensure the rights laid down in the Covenant to anyone with the power or effective control of that State party, even if not situated within the territory of the State party. "
وأوضحت اللجنة المعنية بحقوق الإنسان التطبيق خارج الإقليم في تعليقها العام 31: " على الدولة الطرف أن تحترم وتكفل الحقوق المنصوص عليها في العهد لأي شخص خاضع لسلطة تلك الدولة أو لسيطرتها الفعلية، حتى وإن لم يكن موجوداً داخل إقليم الدولة الطرف " ().

This position was confirmed and further explained in the Committee's general comment No. 31, where the Committee clearly set out that " a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " (emphasis added).

In general comment No. 31 (2004), the HRC stated, " ... a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " .
وتبين اللجنة المعنية بحقوق الإنسان، في التعليق العام رقم 31(2004) " ... أن الدولة الطرف يجب أن تحترم وتكفل الحقوق المنصوص عليها في العهد لأي شخص يخضع لسلطتها أو سيطرتها الفعلية حتى ولو لم يكن موجوداً داخل إقليمها " (75).

While article 2 refers to persons " within [a State Party's] territory and subject to its jurisdiction " , the Human Rights Committee, which monitors implementation of the Covenant, has clarified that " a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " .
