Act No. 39/2004 on the placement and protection of migrant workers abroad included provisions for a 200-hour training session to be given by private training and recruitment agencies; it appeared, however, that the law was poorly enforced.

a. The Government has passed an Act concerning the Placement and protection of migrant workers in 2004, followed by the establishment of a new coordinating body, the National Board for the Placement and protection of migrant workers (BNP2TKI), through Presidential Decree No. 81/2006.

Are legislative guarantees against racial discrimination in place and do they apply to non-citizens regardless of their immigration status? What kind of measures are foreseen by domestic legislation to ensure respect for and protection of migrant workers and their families?
(ب) ما هي الأحكام الأخرى القائمة في القوانين الوطنية الرامية إلى منع كراهية الأجانب والعنصرية والعنف ضد المهاجرين والعمال المهاجرين وأسرهم؟ وهل الضمانات التشريعية ضد التمييز العنصري قائمة وهل تنطبق على غير المواطنين بصرف النظر عن وضعهم كمهاجرين؟ وما هي أنواع التدابير المتوخّاة في التشريعات الداخلية لضمان احترام وحماية العمال المهاجرين وأسرهم؟

In formulating national laws and policies concerning labour migration and the protection of migrant workers in an irregular situation, States are also guided by (a) the ILO Migration for Employment (Revised) Convention, 1949 (No. 97); (b) the Migrant Workers (Supplementary Provisions) Convention, 1975 (No. 143); and (c) the accompanying Recommendations Nos. 86 and 151.
