1- تحترم الحكومات، عن تطبيق أحكام هذا الجزء من الاتفاقية، ما تتصف به علاقة الشعوب المعنية بالأراضي أو الأقاليم، أو بكليهما، حسب الحالة، التي تشغلها أو تنتفع منها بطريقة أخرى، وخاصة الاعتبارات الجماعية في هذه العلاقة، من أهمية خاصة بالنسبة إلى ثقافات هذه الشعوب وقيمها الروحية.

It has been said that indigenous peoples' relationship with their lands and territories is of " special importance for their cultures and spiritual values and ultimately for their continued existence as distinct peoples " .
وقد قيل إن علاقة الشعوب الأصلية بأراضيها وأقاليمها تتسم بأنها " ذات أهمية خاصة لثقافاتها وقيمها الروحية وبالنسبة لاستمرارها كشعوب لها سماتها المتميزة " ().

The Convention obliges concerned Governments to provide " special importance for the cultures and spiritual values of the peoples concerned of their relationship with the lands or territories, or both as applicable, which they occupy or otherwise use, and in particular the collective aspects of this relationship " (article 13).
وتلزم الاتفاقية الحكومات المعنية بإيلاء " أهمية خاصة لثقافات الشعوب المعنية وقيمها الروحية وعلاقتها بما تشغله من أراض أو أقاليم، أو كليهما تبعا لمقتضى الحال، ولا سيما الجوانب الجماعية لهذه العلاقة " (المادة 13).

55. Like the Guiding Principles on Internal Displacement and the Protocol on the Protection and Assistance to Internally Displaced Persons, the Kampala Convention pays particular attention - in its article 4 (5) - to this widespread phenomenon, obliging States parties to endeavour to protect communities with special attachment to and dependency on land owing to their particular culture and spiritual values.
55- واتفاقية كمبالا، شأنها في ذلك شأن المبادئ التوجيهية المتعلقة بالتشرد الداخلي وبروتوكول حماية الأشخاص المشردين داخلياً ومساعدتهم، تولي هذه الظاهرة المتفشية اهتماماً خاصاً في المادة 4(5) منها، وتلزم الدول الأطراف بالعمل على حماية المجتمعات شديدة التعلق بالأراضي والمعتمدة عليها بصورة خاصة نتيجة لثقافتها وقيمها الروحية المميزة.

وتنص المادة ٣١)١( من هذه الاتفاقية على ما يلي: " تحترم الحكومات، عند تطبيق أحكام هذا الجزء من الاتفاقية، ما تتصف به علاقة الشعوب المعنية باﻷراضي أو اﻷقاليم، أو بكليهما، حسب الحالة، التي تشغلها أو تنتفع منها بطريقة أخرى، وخاصة الاعتبارات الجماعية في هذه العلاقة، من أهمية خاصة بالنسبة إلى ثقافات هذه الشعوب وقيمها الروحية " .

The application of transparent procedures and mechanisms by States is a determining factor in the recognition of indigenous peoples' fundamental indigenous rights, such as the right to lands and territories, natural resources and biodiversity in the areas they have traditionally occupied, the right to their cultural resources and the right to develop their own culture, way of life and spirituality.
ويشكل تطبيق الدول إجراءات وآليات شفافة عاملا حاسما في الاعتراف بالحقوق الأساسية للشعوب الأصلية كالحق في الأراضي والأقاليم والموارد الطبيعية والتنوع البيولوجي في المناطق التي تشغلها تقليديا، والحق في مواردها الثقافية والحق في تطوير ثقافتها وطريقة عيشها وقيمها الروحية الخاصة بها.
