Article III(2) Obligation of States not to allow any fishing vessel entitled to fly their flag to be used for fishing on the high seas unless it has been authorized to be so used by the appropriate authority or authorities of that State.
المادة الثالثة (2): تلتزم الدولة بألا تسمح لأي سفينة صيد يحق لها رفع علم تلك الدولة بأن تستخدم في الصيد في أعالي البحار ما لم يكن مرخصا لها بذلك من جانب السلطة أو السلطات المختصة التابعة لتلك الدولة.

Article 91, paragraph 1, provides that ships shall have the nationality of the State whose flag they are entitled to fly and that there must be a genuine link between the State and the ship.b
وتنص الفقرة ١ من المادة ٩١ على أن يكون للسفن جنسية الدولة التي يحق لها رفع علمها، ويجب أن تكون هناك رابطة حقيقية بين الدولة والسفينة)ب(.

Flag States should ensure that fishing vessels entitled to fly their flag do not fish on the high seas or under the jurisdiction of other States unless they have obtained both a Certificate of Registry and an authorization to fish.24

Article III(1)(a) Obligation of States to take such measures as may be necessary to ensure that fishing vessels entitled to fly their flag do not engage in any activity that undermines the effectiveness of international conservation and management measures.

To this end, States should agree, inter alia, on procedures under which the appropriate authorities of one State may board, inspect and, if appropriate, arrest a fishing vessel entitled to fly the flag of another State, including the notification requirements for such action and the procedures under which one State might detain the vessel of another State.

In the final analysis, the immunity of State officials from foreign jurisdiction belongs to the State itself, so that it alone is entitled to waive such immunity.
