In the first instance the State in which a corporation is incorporated is the State of nationality entitled to exercise diplomatic protection.

أما إذا اختلفت الدولة التي يوجد بها مقر الإدارة عن الدولة التي تمارس فيها الرقابة المالية، فإن دولة التأسيس تظل الدولة التي يحق لها ممارسة الحماية الدبلوماسية.

113. A suggestion was made to reformulate paragraph 1 in the following way in order to place greater emphasis on the individual: " The State of nationality is the State entitled to exercise diplomatic protection. "
113 - اقترحت إعادة صياغة الفقرة 1 بالطريقة التالية للتأكيد بقدر أكبر على الفرد: ' ' إن دولة الجنسية هي الدولة التي يحق لها ممارسة الحماية الدبلوماسية``.

It mirrors article 3 (1) of the draft articles adopted by the Commission on first reading, which declares that " the State entitled to exercise diplomatic protection is the State of nationality. "
تتجلى فيها المادة 3 (1) من مشروع المواد الذي أقرته اللجنة في قراءتها الأولى والتي تعلن " أن الدولة التي يحق لها ممارسة الحماية الدبلوماسية هي دولة الجنسية " .

(5) Draft article 9 provides that in the first instance the State in which a corporation is incorporated is the State of nationality entitled to exercise diplomatic protection.
(5) وينص مشروع المادة 9 على أن الدولة التي تأسست فيها الشركة هي بادئ ذي بدء دولة الجنسية التي يحق لها ممارسة الحماية الدبلوماسية.

The State of nationality with the right to exercise diplomatic protection is either the State of incorporation or, if the required conditions are met, the State of the seat of management and financial control of the corporation.
