1. Each State Party shall make the commission of an offence covered by this Convention liable to sanctions that take into account the grave nature of those offences.

2- تنظر الدول الأطراف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عوناً كبيراً في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

3. States Parties shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- تنظر الدول الأطراف في إمكانية منح الحصانة من الملاحقة لأي شخص يقدم عوناً كبيراً في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية، وفقاً للمبادئ الأساسية لقوانينها الداخلية.

1- تنظر كل دولة طرف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عونا كبيرا في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

Article 13 of the Organized Crime Convention establishes a framework for international cooperation for confiscating the proceeds of crime, property, equipment or other instrumentalities obtained pursuant to or used in the commission of an offence covered by the Convention, when such assets are located in the territory of another State party.
57- تحدّد المادة 13 من اتفاقية مكافحة الجريمة المنظّمة إطارا للتعاون الدولي من أجل مصادرة عائدات الجرائم أو الممتلكات أو المعدات أو الأدوات الأخرى المتحصل عليها من ارتكاب جريمة مشمولة بالاتفاقية أو المستخدمة في ارتكابها، عندما تكون تلك الأصول موجودة في إقليم دولة طرف أخرى.

1. This article shall apply to the offences established by the States Parties in accordance with article(s) ___ [alternatively: to an offence covered by this Convention].
١ - تطبق هذه المادة على الجرائم التي تقررها الدول اﻷطراف وفقا للفقرة للمادة )المواد( ــــ ]أو بدلا من ذلك : الجرائم التي تتناولها هذه الاتفاقية[ .

2- تنظر كل دولة طرف في إمكانية منح الحصانة من الملاحقة لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية، وفقا للمبادئ الأساسية لقانونها الداخلي.

١ - يتعين على كل دولة طرف أن تجعل ارتكاب أي جرم مشمول بهذه الاتفاقيةحالما يتم تحديد نطاق الاتفاقية ، ينبغي اعادة النظر في استخدام عبارة " جرم مشمول بهذه الاتفاقية " .

2- تنظر كل دولة طرف في أن تتيح [في قانونها الداخلي]،() في الحالات المناسبة، إمكانية تخفيف عقوبة المتهم الذي يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

Where deemed appropriate, ensure further clarity of legislation regulating the re-assignment of public officials accused of an offence covered by the UNCAC, bearing in mind the need to respect the principle of the presumption of innocence;
- الحرص، حيثما كان ذلك مناسباً، على التأكُّد من زيادة وضوح التشريعات الناظمة لإعادة تعيين الموظفين العموميين المتهمين بارتكاب جرم مشمول باتفاقية مكافحة الفساد، مع مراعاة ضرورة احترام مبدأ افتراض البراءة؛

1. A State party that has received a request from another State party having jurisdiction over an offence covered by this Convention for the confiscation of the proceeds of crime, property, equipment or other instrumentalities referred to in article 22 of this Convention situated in its territory shall, to the greatest extent possible within its domestic legal system:
1 - على الدولة الطرف التي تتلقى طلبا من دولة طرف أخرى لها ولاية قضائية على جرم مشمول بهذه الاتفاقية من أجل مصادرة ما يوجد في إقليمها من عائدات إجرامية أو ممتلكات أو معدات أو أدوات أخرى مشار إليها في المادة 22 من هذه الاتفاقية، أن تقوم، إلى أقصى مدى ممكن في إطار نظامها القانوني الداخلي، بما يلي:

(b) Property, equipment or other instrumentalities used in or intended for use in an offence established in article(s) [...] [alternatively: in an offence covered by this Convention].

Ecuador, referring to attempt to commit an offence covered by the Protocol, explained that under its legislation criminal liability was not established for early preparatory acts that might not lead to the commission of the basic offences.
38- وأشارت إكوادور إلى الشروع في ارتكاب جريمة مشمولة بالبروتوكول، وبيّنت أن المسؤولية الجنائية بمقتضى تشريعاتها ليست قائمة فيما يتعلق بالأفعال التحضيرية المبكرة التي قد لا تؤدي إلى ارتكاب الجرائم الأساسية.

States Parties shall give consideration to the possibility of transferring to one another proceedings for criminal prosecution of an offence established in article(s) ___ [alternatively: of an offence covered by this Convention] in cases where such transfer is considered to be in the interests of the proper administration of justice, in particular in cases where more jurisdictions are involved, with a view to concentrating the prosecution.
تنظر الدول اﻷطراف في امكانية أن تنقل من احداها الى اﻷخرى دعاوى الملاحقة الجنائية للجرائم المبينة في المادة )المواد( _____ ]أو بدلا من ذلك : الجرائم التي تتناولها هذه الاتفاقية[ في الحالات التي يعتبر فيها ذلك النقل في صالح اقامة العدالة على نحو سليم ، وخصوصا في الحالات التي تمس أكثر من ولاية قضائية واحدة ، وذلك بهدف تركيز الملاحقة .
