(b) “Detained person” means any person deprived of personal liberty except as a result of conviction for an offence;

It is essential to draw up a list of all persons who are effectively detained at any given moment and to keep a strict record of the date and time at which any person deprived of his liberty is admitted to a detention centre, transferred to another centre or released, together with a clear indication of the judicial authority for each act.

The Working Group reiterates articles 2 and 10 of the Declaration, which provide that " no State shall practise, permit or tolerate enforced disappearances " , and that " accurate information on the detention of any person deprived of liberty and their place or places of detention shall be made promptly available to their family members, their counsel " .

77. any person deprived of freedom of movement by virtue of being held in police custody for the purposes of an investigation is immediately informed of the nature of the offence with which the investigation is dealing and the provisions concerning the duration of custody and related rights, including the right to the assistance of legal counsel.

88. In Burkina Faso, legal safeguards are in place to ensure that any person deprived of his or her liberty or any other person with a legitimate interest is entitled to take proceedings before a court.
