As their names suggest, the object of guardianship (tutela, from tueri, to defend and protect) and curatorship (from cura and curatio, care), is to protect those who are legally incompetent.
وكما يشير الاسم، يتمثل الهدف من الوصاية )من اﻷصل اللاتيني tutela المشتقة من tueri وتعني الدفاع والحماية( والقوامة )من cura وcuratio بمعنى الرعاية( في حماية اﻷشخاص فاقدي اﻷهلية القانونية.

Where a child's parents have different surnames, the mother's or father's surname shall be assigned by agreement between the parents or, in the absence of agreement, by order of the guardianship and curatorship authority (art. 63).
واذا كان اﻷبوان يحملان اسمي عائلتين مختلفين، يمنح الطفل إما اسم عائلة اﻷم أو اسم عائلة اﻷب وذلك بالاتفاق فيما بين اﻷبوين، أو في حالة عدم وجود اتفاق، يتحدد هذا اﻹسم بأمر من سلطة الوصاية والقوامة )المادة ٣٦(.

Guardianship and curatorship shall be instituted for the upbringing of minor children who, as a result of the death of their parents, the forfeiture of parental rights by their parents or the illness of their parents or for other reasons, have been left without parental care, and also to protect the personal and property rights and interests of such children (art. 138).
تُقرر الوصاية والقوامة لرعاية اﻷطفال القصر، الذين أصبحوا نتيجة لموت اﻷبوين، أو لسقوط حقوقهما اﻷبوية، أو لمرضهما أو ﻷسباب أخرى، متروكين بلا رعاية أبوية، وأيضاً لحماية الحقوق الشخصية لﻷطفال وحقوقهم في الملكية ومصالحهم )المادة ٨٣١(.

These institutions are governed by Parts IX and X of Book I of the Civil Code, which govern deprivation of capacity (articles 199 to 201), guardianship (articles 215 to 285), curatorship (articles 286 to 293), the Legal Defender and the de facto custodian (articles 303 and 304).
