In its general comment 6 [16] adopted at its 378th meeting on 27 July 1982, the Human Rights Committee observed that the right to life enunciated in the first paragraph of article 6 of the International Covenant on Civil and Political Rights is the supreme right from which no derogation is permitted even in time of public emergency.

In conformity with several United Nations, Council of Europe, Organization of American States, International Labour Organization and International Committee of the Red Cross conventions, the prohibition of torture is a right that must be protected under all circumstances, to which " no derogation " may be made, even in time of public emergency, internal or international disturbance or armed conflict.
