The right to family pension may be exercised by the family members of a deceased beneficiary who has had a contributory period of at least 5 years or at least 10 years of pensionable service, or met the conditions for an old-age or disability pension, or family members of a deceased beneficiary of an old-age or disability pension or the right on the basis of remaining working capacity.
89- ويمكن أن يمارس الحق في معاش الأسرة أفراد أسرة مستفيد متوفي له مدة اشتراك لا تقل عن 5 سنوات أو خدمة مستحقة للمعاش لا تقل عن عشر سنوات أو استوفى بشروط معاش الشيخوخة أو العجز، أو أفراد مستفيد متوفي بمعاش الشيخوخة أو العجز أو الحق على أساس قدرة العمل المتبقية.

The members of the family obtain the right to a family pension if the deceased insured person has 5 years of insurance length or 10 years of length of service, if he/she has met the requirements for an old-age and disability pension, and if the death of the insured person has occurred upon injury at the workplace.
261- ويحصل أفراد العائلة على حق المعاش الأسري إذا كان لدى المؤمِّن المتوفى تأمين لمدة 5 سنوات أو مدة خدمة قدرها 10 سنوات واستوفى شروط التقاعد بسبب العمر أو الإعاقة وإذا توفي الشخص المؤمّن إثر إصابة في مكان العمل.

The amount of a family pension should not exceed the amount of the pension that the deceased had or would have received.
212- وينبغي ألا يتجاوز مجموع المعاش العائلي مقدار المعاش الذي كان يتلقاه أو كان من المفروض أن يتلقاه المتوفى.

A person is eligible for a family pension after it is proved that he was maintained by the person who died, within the calendar year after the insurance termination, provided that the deceased was receiving a retirement pension or had fulfilled the requirements for a disability or oldage pension.
