8. In submitting his first report to the Commission, the Special Rapporteur deems it necessary to underline one particular aspect of the prohibition of torture and cruel, inhuman and degrading treatment or punishment, namely, the non-derogable nature of this prohibition.
8- إن من الضروري في نظر المقرر الخاص وهو يقدم تقريره الأول إلى اللجنة أن يؤكد على جانب خاص من جوانب حظر التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ألا وهو طابع عدم جواز تقييد هذا الحظر.

2. As indicated in his first report to the Commission (E/CN.4/2002/137, para. 3), the Special Rapporteur adheres to the principle of continuity in the discharge of the mandate conferred upon him pursuant to the relevant Commission resolution.

As indicated in his first report to the Commission (E/CN.4/2002/137, para. 6), the Special Rapporteur attaches great importance to follow-up activities and considers them to be an essential requirement of his mandate. He therefore intends to seek ways to enhance the quality of such activities, in particular in cooperation with the Quick Response Desk.

In his first report to the Commission (E/CN.4/2001/51), the Special Rapporteur called for a broad interpretation of the right to adequate housing, which he defined as " the right of every woman, man, youth and child to gain and sustain a secure home and community in which to live in peace and dignity " .

The Special Rapporteur focused his first report to the Commission on the evaluation of the implementation of recent legislation at the national level relating to the rights of indigenous peoples and his second report (E/CN.4/2003/90) on the impact of development projects on the human rights and fundamental freedoms of indigenous communities.
