Based on a broad consensus, this decision sent an important and universal message on the need to protect the populations of the world from genocide, war crimes, ethnic cleansing and crimes against humanity, as well as from the incitement to such crimes.

Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.

97. In their replies, many States indicated that acts of racial discrimination and/or incitement to such acts were prohibited by law.

The Committee recalled that article 4 of the Convention requires States parties to penalize four categories of misconduct: (i) dissemination of ideas based upon racial superiority or hatred; (ii) incitement to racial hatred; (iii) acts of violence against any race or group of persons of another colour or ethnic origin; and (iv) incitement to such acts.

64. Each individual State has the responsibility to protect its populations from the four aforementioned crimes; this entails prevention measures, including the prevention of incitement to such crimes.

Notes that article 4 (b) of the International Convention on the Elimination of All Forms of Racial Discrimination places an obligation upon States to be vigilant and to proceed against organizations that disseminate ideas based on racial superiority or hatred, acts of violence or incitement to such acts; those organizations shall be condemned and discouraged;

Accordingly, Omani authorities and institutions do not perform any acts of racial discrimination or acts that may lead to support of or incitement to such acts.

The Committee recommends that the State party, declare as offences punishable by law any assistance to racist activities and the financing thereof, participation in racist organizations, acts of racial violence and incitement to such acts, and any refusal to provide goods or services on racist grounds.

The Committee recommends that the State party amend the definition of extremism in the Law on Combating Extremism and in articles 280 and 282 of the Criminal Code to ensure that it is clearly and precisely worded, covering only acts of violence, incitement to such acts, and participation in organizations that promote and incite racial discrimination, in accordance with article 4 of the Convention.
