1. The State of origin shall take necessary measures to ensure that prompt and adequate compensation is available for persons in another State suffering transboundary damage caused by a hazardous activity located within its territory or in places under its jurisdiction or control.
1 - تتخذ دولة المصدر التدابير الضرورية لضمان إتاحة التعويض الفوري والملائم للأشخاص الذين يتكبدون في دولة أخرى ضررا عابرا للحدود ناشئا عن نشاط خطير واقع داخل إقليمها أو في أماكن تخضع لولايتها أو سيطرتها.

2. The State of origin shall also take necessary measures to ensure that such prompt and adequate compensation is available for transboundary damage to the environment or natural resources of any State or of the areas beyond the jurisdiction and control of any State arising from the hazardous activity located within its territory or in places under its jurisdiction or control.

It is obvious that a reservation to the Convention on the Prevention and Punishment of the Crime of Genocide by which a State sought to reserve the right to commit some of the prohibited acts in its territory or in certain parts thereof would be incompatible with the object and purpose of the Convention.

Similarly, in the Pulp Mills on the River Uruguay case, the Court found that the principle of prevention was part of customary international law and that a State was thus obliged to use all the means at its disposal in order to avoid activities that took place in its territory or in any area under its jurisdiction causing significant damage to the environment of another State.

In this context, it is also understood that each State is free to determine the priorities of its economic development in accordance with its own national policies and for this purpose to utilize and develop the natural resources within its territory or in areas under its jurisdiction or control in accordance with the principle of sovereignty and the permanent sovereignty over its natural resources.
