He maintains that his migration agent failed to prepare properly his application for a Protection Visa, that he failed to disclose himself as a registered migration agent on the Protection Visa and Refugee Review Tribunal applications, and that he submitted to the authorities wrong information as to the address of the complainant.
ويؤكد صاحب الشكوى أن موظف الهجرة لم يقم بإعداد طلب تأشيرة الحماية على النحو المناسب، ولم يقدّم نفسه كموظف هجرة معتمد عند ملء طلبات تأشيرة الحماية والطلبات المقدّمة إلى محكمة مراجعة الأحكام الخاصة باللاجئين، وزوّد السلطات بمعلومات خاطئة عن عنوان صاحب الشكوى.

Where there exists " migration agent fraud " in a person's protection application, that may be found to amount to jurisdictional error, but such findings are rare.
وإن ثبت " تزوير موظف الهجرة " في طلب الحماية المقدّم من أحد الأشخاص، قد يُعتبر ذلك بمثابة خطأ قضائي، إلا أن هذا النوع من الحالات نادر.

Because of the general unreliability of the complainant's evidence to the Court, the Court was not persuaded that the complainant did not attend the Tribunal hearing as a result of a fraudulent statement by his migration agent.

7.2 The complainant further stresses that the State party has not addressed her claim that she was given misguiding advice by the migration agent before benefitting from legal counsel to prepare her protection visa application.
7-2 وتؤكد صاحبة الشكوى أيضاً على أن الدولة الطرف لم تنظر في إدعائها بأن المشورة التي قدمها إليها ضابط الهجرة كانت مضللة وذلك قبل أن تحصل على المشورة القانونية لإعداد طلبها للحصول على تأشيرة الحماية.

4.13 The State party draws the attention of the Committee to the fact that, in the present case, the author had the assistance of a migration agent in making his initial application and that an interview was conducted with him by an officer of the Department of Immigration and Multicultural Affairs with the assistance of an interpreter.
