Some considered that the preparation of a model law or an expanded guide should not require much time, as most issues are already addressed in the UNCITRAL PFIPs instruments, while others were of the view that a considerable amount of work remained to bring the existing texts up to date and in order to prepare a model law.

Mr. Loken (United States of America) said that the Commission had given the Working Group the mandate to carry out the work described in paragraph 259 (a) of the Commission's report on its forty-third session (A/65/17), which raised the possibility of the development of " a model law or provisions on insolvency law " .

UNCTAD is also mandated to continue work on the elaboration of a model law or laws on RBPs in order to assist developing countries in devising appropriate legislation, and to implement or facilitate technical assistance, advisory and training programmes on restrictive business practices, particularly for developing countries, through various methods (see arts. F.5 and F.6 of the Set).

The Set also provides for work aimed at achieving common approaches in national policies relating to RBPs compatible with the Set (article F.1) and continued work on the elaboration of a model law or laws on RBPs in order to assist developing countries in devising appropriate legislation (article F.2).
