In collaboration with indigenous peoples and Governments concerned, the United Nations should establish a trust fund with a mandate to act as a global agent for the recovery of compensation for the unconsented or inappropriate use of indigenous peoples' heritage, and to assist indigenous peoples in developing the institutional capacity to defend their own heritage.
53- ينبغي للأمم المتحدة، بالتعاون مع الشعوب الأصلية والحكومات المعنية، أن تنشئ صندوقا استئمانياً يُناط به العمل كوكيل عالمي لتحصيل التعويضات عن استخدام تراث الشعوب الأصلية استخداماً غير مأذون أو مناسب، ولمساعدة الشعوب الأصلية على تطوير قدرتها المؤسسية على حماية تراثها الذاتي.

Of note are the principles that indigenous peoples' ownership and custody of their heritage must continue to be collective, permanent and inalienable; that the free and informed consent of the traditional owners be a precondition of any agreements for the recording, study, use or display of indigenous peoples' heritage; and that concerned peoples be the primary beneficiaries of commercial application of their heritage.

(c) deny to any person or corporation the right to obtain patent, copyright or other legal protection for any element of indigenous peoples' heritage without adequate documentation of the free and informed consent of the traditional owners to an arrangement for the sharing of ownership, control, use and benefits;

The United Nations should publish and circulate to all parties concerned (Governments, international organizations, indigenous peoples and non-governmental organizations) a comprehensive annual report, based upon information from all available sources, including indigenous peoples themselves, on the problems experienced and solutions adopted in the protection of indigenous peoples' heritage in all countries.
50- ينبغي للأمم المتحدة أن تنشر وتعمم على جميع الأطراف المعنية (الحكومات والمنظمات الدولية ومنظمات الشعوب الأصلية والمنظمات غير الحكومية) تقريراً سنوياً شاملاً، يستند إلى معلومات من جميع المصادر المتاحة، بما في ذلك الشعوب الأصلية ذاتها، عما يواجَه من مشاكل وما يُعتمد من حلول في حماية تراث الشعوب الأصلية في جميع البلدان.

Thus, as a general rule, use of elements of indigenous peoples' heritage that conventional intellectual property laws regard as being in the so-called public domain that had been placed there without the free, prior and informed consent of the relevant indigenous peoples(s) or individual(s) consent shall be discontinued if free, prior and informed consent for their continued use cannot be obtained.
