12. While noting that Section 18 of the Constitution of the State party prohibits discrimination of any kind and unfair treatment, the Committee remains concerned at the absence of a specific prohibition of discrimination against women as defined in article 1 of the Convention.

As an automatic consequence of their placement under guardianship, the authors' names were removed from the electoral register, pursuant to article 70, paragraph 5, of the Constitution of the State party that was applicable at the time, which provided that persons placed under total or partial guardianship did not have the right to vote.

12. The Committee notes with appreciation that article 22 of the Constitution of the State party and other legislation guarantee the right to non-discrimination and equality to all citizens.

13. While noting that article 6 of the Constitution of the State party includes a definition of discrimination in conformity with article 1 of the Convention, the Committee is concerned about the fact that the absence of a comprehensive law on gender equality continues to be a challenge for the effective implementation of the principle of non-discrimination and gender equality.

The Committee also notes with concern that the omission of the ground of " sex " among the grounds of non-discrimination in the provisions of article 29 of the Constitution of the State party deprives women of a crucial legal protection against gender-based discrimination (art. 3).

5. While observing that article 19 of the Constitution of the State party makes reference to a number of human rights treaties, the Committee however notes that the provisions of the Covenant have not been directly applied or invoked by the State party's courts (art. 2).

While noting that article 6 of the Constitution of the State party provides for equality before the law, the Committee regrets that the Constitution does not embody the principle of equality between women and men nor contain a definition of discrimination against women in accordance with article 1 of the Convention.
14- تحيط اللجنة علماً بأن المادة 6 من دستور الدولة الطرف تنص على المساواة أمام القانون، غير أنها تعرب عن الأسف لأن الدستور لا يكرس مبدأ المساواة بين الرجل والمرأة ولا يتضمن أي تعريف للتمييز ضد المرأة وفقاً للمادة 1 من الاتفاقية.

Moreover, in view of the numerous decisions of the State party's courts to the effect that the provisions of the Covenant are not self-executing and thus not binding in accordance with articles 93 and 94 of the Constitution of the State party, the Committee urges the State party to consider all remedial measures, legislative or otherwise, to ensure that the Covenant rights are applicable and justiciable in all its constituent countries.
