42. Accordingly, the Committee resolved at its sixth session to begin in due course to consider the situation concerning the implementation of the Covenant in respect of each State party whose reports are very significantly overdue.

However, given the robust opposition voiced by several non-governmental organizations (NGOs), the Chamber of Senators decided to align its legislation with article 9 of the Covenant in respect of challenges to arbitrary pretrial detention and habeas corpus, and by rejecting the original proposal to extend the duration of detention to four years.

3.5 In conclusion, the authors repeat their request to the Committee to find that the State party has acted in violation of article 2, paragraph 3, articles 7, 9 and 16 of the Covenant in respect of Djamel Saadoun, and of article 2, paragraph 3, and article 7 of the Covenant in respect of the authors themselves.

8- وإن اللجنة المعنية بحقوق الإنسان، إذ تتصرف بموجب الفقرة 4 من المادة 5 من البروتوكول الاختياري للعهد الدولي الخاص بالحقوق المدنية والسياسية، ترى أن الوقائع المعروضة عليها تكشف عن حدوث انتهاك للفقرة 2 من المادة 19 من العهد بخصوص صاحب البلاغ.

She also invokes the rights contained in articles 7 and 10 of the Covenant in respect of the conditions of detention and lack of medical treatment.
