It was suggested that a State or an international organization should not be able to formulate an interpretative declaration in respect of a treaty or certain of its provisions in the context of a dispute-settlement process involving the interpretation of the treaty or the provisions in question.

His understanding of the phrase that followed the word " except " was that when a unilateral statement was made with the intent to exclude or modify certain provisions of the treaty or the treaty as a whole, such a statement was not a mere interpretative declaration, but a reservation or conditional interpretative declaration having the same legal effect as a reservation.

2 - وفي أي حالة أخرى، تتحدد نية الأطراف في معاهدة فيما يتعلق بإنهائها أو تعليقها في حالة النـزاع المسلح، عندما يقوم خلاف بين الأطراف في هذا الصدد، بأي وسائل معقولة ويجوز أن تكون من بينها الأعمال التحضيرية للمعاهدة أو ظروف إبرامها.
