The present articles apply to activities not prohibited by international law and carried out in the territory or otherwise under the jurisdiction or control of a State which involve a risk of causing significant transboundary harm through their physical consequences.

(j) " State of injury " means the State in the territory or otherwise under the jurisdiction or control of which transboundary damage occurs;
(ي) يقصد بـ ' ' دولة الإصابة`` الدولة التي حدث الضرر العابر للحدود في إقليميها أو تحت ولايتها أو سيطرتها؛

(a) " affected State " means the State in the territory or otherwise under the jurisdiction or control of which persons, property or the environment are affected by a disaster;
(أ) يقصد بمصطلح " الدولة المتأثرة " الدولة التي تأثر أشخاص أو ممتلكات، أو تأثرت البيئة بكارثة، في إقليمها أو في أماكن أخرى تخضع لولايتها أو سيطرتها؛

(a) all activities within the scope of the present draft articles carried out in the territory or otherwise under the jurisdiction or control of a State;

If a State has reasonable grounds to believe that an activity planned or carried out in the State of origin territory or otherwise under the jurisdiction or control of another State may have a risk of causing significant transboundary harm, the former State may request the latter to apply the provision of article 9 [10].
1- إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم الدولة المصدر دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة الأولى أن تطلب من الدولة الثانية تطبيق حكم المادة 9 [10].

1. If a State has reasonable grounds to believe that an activity planned or carried out in the State of origin territory or otherwise under the jurisdiction or control of another State may have a risk of causing significant transboundary harm, the former State may request the latter to apply the provision of article 9 [10].
1 - إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم الدولة المصدر دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة الأولى أن تطلب من الدولة الثانية تطبيق حكم المادة 9 [10].

When no notification has been given of an activity conducted in the territory or otherwise under the jurisdiction or control of a State, any other State which has serious reason to believe that the activity has created a risk or has caused it significant harm may require consultations under article 18.
١ - في اﻷحوال التي لم يتم فيها اﻹخطار بنشاط يجري القيام به في إقليم إحدى الدول أو تحت ولايتها أو سيطرتها، يجوز ﻷي دولة أخرى لديها أسباب وجيهة للاعتقاد بأن ذلك النشاط قد أوجد مخاطر وقوع ضرر ملموس لها أو تسبب في هذا الضرر أن تطلب إجراء مشاورات بمقتضى المادة ١٨.

The provision could go further and add " or otherwise under the jurisdiction or control " , as was done in the articles on prevention of transboundary harm from hazardous activities adopted by the Commission in 2001.
