Article 146 requires States parties to enact any legislation necessary to provide effective penal sanctions for persons committing, or ordering to be committed, any of the listed grave breaches.
289- وتلزم المادة 146 الدول الأطراف بأن تتخذ أي إجراء تشريعي يلزم لفرض عقوبات جزائية فعالة على الأشخاص الذين يقترفون، أو يأمرون باقتراف، أحد الخروق الجسيمة المدرجة في هذه الاتفاقية.

120. The representative of the Philippines proposed to add a new second paragraph to the second option for article 2, which would read as follows: " States Parties shall apply legal sanctions to persons committing or ordering to be committed a breach of paragraph 1 of this article " .

As for the grave breaches, the provision imposes on each High Contracting Party the duty to enact “any legislation necessary to provide effective penal sanctions for persons committing, or ordering to be committed, any of grave breaches ...” of the Convention.

In addition, the decisions of the Israeli Court are a grave breach of the Fourth Geneva Convention which states in articles 146 and 147 that Contracting Parties shall “enact any legislation necessary to provide elective penal sanctions for persons committing or ordering to be committed, any of the grave breaches of the present Convention” which includes, “wilful killing, torture or inhuman treatment”.
