" ويراد بتعبير " تحفظ " إعلان أحادي، أيا كانت صيغته أو تسميته، تصدره دولة حين توقع معاهدة أو تصدقها أو تقبلها أو تقرها أو تنضم إليها، أو حين تقوم بالإشعار بالخلافة في معاهدة، مستهدفة به استبعاد أو تغيير الأثر القانوني لبعض أحكام المعاهدة في تطبيقها على تلك الدولة " ()

If, however, the declaration seeks to exclude or modify the legal effect of certain provisions of the treaty in their application to its author, the declaration must be considered an impermissible reservation.”

It was pointed out that the Commission ought to approach the question covered in draft guideline 3.1.7 from the standpoint of procedure and ask whether a reservation drafted in vague and general terms could be said to intend to exclude or modify the legal effect of certain provisions of the treaty in their application to the reserving State. Attention was also drawn to the importance of context and specific circumstances.
418- وأما عن مشروع المبدأ التوجيهي 3-1-7 فقد أبرز أنه ينبغي للجنة أن تتناول المسألة من وجهة الإجراءات وأن تتساءل عما إذا كان من الممكن القول إن تحفظاً حرر بتعابير غامضة وعامة يستهدف استبعاد أو تعديل الأثر القانوني لبعض أحكام المعاهدة في تطبيقها على الدولة التي أبدت التحفظ، وأبرزت كذلك أهمية السياق والظروف الخاصة.

With identical wording, both treaties stipulate that “reservation” means a unilateral statement, however phrased or named, made by a State, when signing, ratifying, accepting, approving or acceding to a treaty, whereby it purports to exclude or to modify the legal effects of certain provisions of the treaty in their application to that State (art. 2, para. 1 (d)).
