However, the Committee is concerned that there is no specific provision criminalizing the recruitment of children below the age of 18, nor a specific provision providing extraterritorial jurisdiction in case of recruitment of a Kazakh child outside the country, or recruitment of children by a Kazakh citizen outside Kazakhstan.

6. In light of the important role of the International Criminal Court in deterring the recruitment of children below the age of 15 on an international level, please inform the Committee of the State Party's intentions with regard to the ratification of the Statute of the International Criminal Court, which the State Party signed on 22 November 2000.

48. The United Nations supports the early removal of children from armed forces and groups in compliance with the Rome Statute of the International Criminal Court, which makes the recruitment of children below 15 years of age a war crime, and the Optional Protocol to the Convention on the Rights of the Child, which prohibits signatories from forcefully recruiting children below the age of 18 years.

The Committee, while recognising the reference to the right of persons under 18 years old not to be recruited, even in case of armed conflict, in the Integral Law for the Protection of Children and Adolescents of 2003, is concerned that there is no clear prohibition of the recruitment of children below the age of 18 and no specific provision in the Criminal Code criminalizing forced recruitment below the age of 18.
501- إن اللجنة، إذ تقدر الإشارة، في القانون الشامل لحماية الأطفال والمراهقين لسنة 2003، إلى حق الأشخاص الذين تقل أعمارهم عن 18 سنة في ألا يُجندوا، حتى في حالة النزاعات المسلحة، تشعر بالقلق لعدم وجود حظر واضح لتجنيد الأطفال دون سن ال18 ولا أي حكم معين في القانون الجنائي يُجرِّم التجنيد القسري لمن تقل أعمارهم عن 18 سنة.
