8. This article shall apply to Members even after the expiry of their terms of office if they continue to exercise their functions, in accordance with article 5, paragraph 3, of the Statute.

وكان مجلس الأمن قد قرر، في قراره 1900 (2009) المؤرخ 16 كانون الأول/ ديسمبر 2009، أن يتم القاضيان كيمبرلي بروست وأولي بيورن ستول قضية بوبوفيتش، رغم انتهاء فترة ولايتهما في 31 كانون الأول/ديسمبر 2009.

In the light of the above, the approval of the Security Council, as the parent organ of the International Tribunal, and of the General Assembly, as the organ that elects its judges, is necessary to allow Judges Prost and Støle to complete the Popović case, notwithstanding the expiry of their terms of office.
وبناء على ما تقدم، فمن الضروري الحصول على موافقة كل من مجلس الأمن باعتباره الهيئة الأم للمحكمة الدولية، والجمعية العامة، باعتبارها الهيئة التي تنتخب قضاتها، ليتسنى للقاضيين بروست وستول إتمام قضية بوبوفيتش، رغم انتهاء فترة ولايتهما.

In the absence of any such provision, the approval of the Security Council, as the parent organ of the Tribunal, and of the General Assembly, as the organ that elects its judges, would be needed in order to permit the seven ad litem judges concerned to continue to serve in the Tribunal beyond 11 June 2005 and to finish the cases in which they are currently adjudicating, notwithstanding the expiry of their terms of office.
وفي غياب مثل هذا الحكم، فإن موافقة مجلس الأمن، باعتباره الهيئة الأم للمحكمة، وموافقة الجمعية العامة، باعتبارها الهيئة التي تنتخب قضاتها، ستكون مطلوبة حتى تسمح للقضاة السبعة المخصصين المعنيين مواصلة عملهم في المحكمة، لمدة تتجاوز 11 حزيران/يونيه 2005، وللانتهاء من القضايا التي ينظرون فيها حاليا، على الرغم من انتهاء فترة ولايتهم الوظيفية.
