We particularly welcome the reiteration of the principle of responsible sovereignty, and the move away from the false dichotomies sometimes posed in that connection between the interests of the State and its populations, and between the interests of the State and those of the international community.

That notion of a fair balance between the interests of the State and those of the individual in question derived directly from the jurisprudence of the European Court of Human Rights which, of all the universal and regional courts, was the one that had the most abundant and highly developed case law on the notion of a right to private and family life.

2. The expelling State shall not interfere with the exercise of the right to family life, except where provided by law and on the basis of a fair balance between the interests of the State and those of the alien in question.

(6) The second condition relates to the " fair balance " that must be achieved between the interests of the State and those of the alien in question.

According to this case-law, the expelling State may interfere with the exercise of the right to family life only where provided by law and in achieving a " fair balance " between the interests of the State and those of the alien in question.

The Nordic countries, as parties to the European Convention on Human Rights, welcomed the inclusion in draft article 20, paragraph 2, of the notion of a " fair balance between the interests of the State and those of the alien " , which was inspired by the case law of the European Court of Human Rights.

The European Court of Human Rights had given a very restrictive interpretation of that right in its jurisprudence, and draft article 13, paragraph 2, which spoke of striking " a fair balance between the interests of the State and those of the person in question " , did not afford the expellee much protection either.
وتوصلت المحكمة الأوروبية لحقوق الإنسان إلى تفسير ضيق جداً لهذا الحق سوابقها القضائية. كما أن الفقرة 2 من مشروع المادة 13 التي أشارت إلى " مراعاة توازن عادل بين مصالح الدولة ومصالح الشخص المعني " لم تكفل للمطرود حماية كافية.

Paragraph 2 of draft article 20 establishes two cumulative conditions on which the State may interfere with the right to family life of a person subject to expulsion, namely: (1) that the restriction is provided by law, and (2) that a fair balance is maintained between the interests of the State and those of the alien in question.

However, he doubted that paragraph 2 of draft article 13 (Obligation to respect the right to private and family life), which indicated that a State " shall strike a fair balance between the interests of the State and those of the person in question " , would be operable as, in practice, it would be extremely difficult to determine whether that balance had been achieved.
