These measures encompass all juveniles at risk of delinquency, in accordance with the Juvenile Welfare Act.

82. The Iraqi Civil Code defines as a child every human being below the age of 18 years. the Juvenile Welfare Act No. 76 (1983) places children in the following categories, by age group:

The juvenile courts have the discretion to use alternatives to detention, depending on the nature and gravity of the offence in the case and how it is defined in the Juvenile Welfare Act.
أما بخصوص تطبيق التدابير البديلة للعقوبات السالبة للحرية فإنها من اختصاص محاكم الأحداث وحسب نوع وجسامه الجرائم المرتكبة من قبل الحدث والمنصوص عليها أصولياً في قانون رعاية الأحداث.

In that context, the Government has submitted a draft amendment to the Juvenile Welfare Act (Republican Legislative Decree No. 24 of 1992) which is still blocked in the House of Representatives for reasons that have to do with the sharia. 81. Article 20 of the Juvenile Welfare Act No. 24 of 1992 stipulates as follows:
81- كما نصت المادة 20 من القانون رقم 24 لسنة 1992 بشأن رعاية الأحداث ما يلي:

the Juvenile Welfare Centre operates on the basis of a " family system " in which juveniles are distributed among the various families in accordance with their age and the extent of their delinquency.
155- ويقوم العمل في مركز رعاية الأحداث على نظام الأسر، ويتم توزيع الأحداث على الأسر المختلفة وفقاً للسن ودرجة الإنحراف.

The juveniles remain in the institutions or the Juvenile Welfare Centre for a period of not more than one year until their conduct improves.
كما لم يحدد القانون مدة ايداع الحدث بمؤسسات الرعاية الإجتماعية حتى لا يتخذ الإيداع صفة العقوبـة، فالحـدث يبقى في المؤسسة أو مركز رعاية الأحداث الى ان يتحسن سلوكه بحيث لا تتجاوز الفترة السنة.

356. the Juvenile Welfare Act also stipulates the same measures for depriving children of their liberty and moreover creates the appropriate mechanisms for that purpose, as discussed in previous paragraphs.
355- كما نص قانون رعاية الأحداث على ذات التدابير البديلة لحرمان الطفل من حريته، بل أوجد الآليات المناسبة لذلك كما رأينا في الفقرات السابقة من هذا التقرير.

A juvenile court has the sole jurisdiction to try juveniles accused of felony or misdemeanour, or juveniles prone to delinquency according to the evaluation of the Juvenile Welfare Commission.
وتختص محكمة الأحداث دون غيرها بالنظر في أمر الحدث عند اتهامه في جناية أو جنحة أو عند تعرضه للانحراف إذا رأت هيئة رعاية الأحداث ذلك.

the Juvenile Welfare Act, for its part, makes provision for a number of preventive rehabilitation measures aimed at the rehabilitation and social reintegration of young offenders. Those measures include:
ويندرج ضمن قانون رعاية الأحداث عدد من الإجراءات والتدابير الوقائية التأهيلية والعلاجية لانتشال الحدث وإدماجه في المجتمع ومنها:

Article 18 of the Law stipulates that juveniles prone to delinquency shall be handed over to the competent section of the Ministry of Social Affairs and Labour; the Ministry shall make arrangements for their accommodation in appropriate houses and the Juvenile Welfare Department shall handle all matters relating to the juvenile during a period of time that may be renewed by a decision of the Minister of Social Affairs and Labour.
وجاء في المادة 18 أنه يجب تسليم الأحداث المعرضين للانحراف مباشرة إلى الجهات المختصة بوزارة الشؤون الاجتماعية والعمل وعليها إعداد الأماكن المناسبة لاستقبالهم، وعلى هيئة رعاية الأحداث التصرف في أمرهم خلال المدة التي يجوز أن يصدر بتجديدها قرار من وزير الشؤون الاجتماعية والعمل.

Article 26 states that the juvenile court shall have judicial penal jurisdiction in all cases involving delinquent juveniles and judicial power to examine the conditions of juveniles prone to delinquency in the cases presented to the court by the Juvenile Welfare Commission through the Juvenile Parquet.
وجاء في المادة 26 أن لمحكمة الأحداث سلطة قضائية جزائية في جميع قضايا الأحداث المنحرفين وسلطة قضائية للنظر في ظروف الأحداث المعرضين للانحراف الذين ترى هيئة رعاية الأحداث عرضهم على المحكمة عن طريق نيابة الأحداث.
