Each State Party shall adopt such measures as may be necessary, including, where appropriate, domestic legislation, to ensure that criminal acts within the scope of this Convention are under no circumstances justifiable by considerations of a political, philosophical, ideological, racial, ethnic, religious or other similar nature.

When considering whether a particular offence falls within the scope of this Convention, they shall take into account (a) the seriousness of the offence, (b) the involvement of a criminal organization in committing the offence and (c) the transnational effect of the offence.

(a) To establish as criminal offences under its domestic law the offences within the scope of this Convention as set forth in article 2;
)أ( لكي تُجرﱢم بموجب قانونهـا الداخلـي اﻷفعـال اﻹجراميـة الداخلة في نطاق هذه الاتفاقية على النحو المنصوص عليه في المادة ٢؛

Since the scope of this Convention should include some element related to “organized criminal activity”, there should be some limitation to this provision in order to make it relevant to such an element.

(iii) Monitoring data in biota indicating that the bio-accumulation potential of the chemical is sufficient to justify its consideration within the scope of this Convention " .
' 3` رصد البيانات في الحيويّات (نبات منطقة وحيواناتها) رصداً يُشيرُ إلى أن احتمال التراكم الأحيائي للمادة الكيميائية كافٍ لتبرير اعتبارها داخلةً في نطاق هذه الاتفاقية. "

10. Each State Party is under the obligation to keep the inspection request within the scope of this Convention and to provide in the inspection request all appropriate information on the basis of which a concern has arisen regarding possible non-compliance with this Convention as specified in the Verification Annex.
10 - كل دولة طرف ملزمة بألا يخرج طلب التفتيش عن نطاق هذه الاتفاقية وبتضمينه جميع المعلومات المناسبة عن أسباب نشوء القلق بشأن عدم الامتثال المحتمل لهذه الاتفاقية على النحو المحدد في المرفق المتعلق بالتحقق.

18. The Executive Council may, not later than 12 hours after having received the inspection request, decide by a three-quarter majority of all its members against carrying out the challenge inspection, if it considers the inspection request to be frivolous, abusive or clearly beyond the scope of this Convention as described in paragraph 9.
