49. As an example, in the European Community, article 81 (1) of the Treaty of Rome prohibits and declares " incompatible with the common market: all arrangements between undertakings, decisions by associations of undertakings and concerted practices which may affect trade between member States and which have as their object or effect the prevention, restriction or distortion of competition within the common market " .
49- ومن ذلك مثلاً، في حالة الجماعة الأوروبية، أن المادة 81(1) من معاهدة روما تحظر ما يلي وتعلن " تعارضه مع السوق المشتركة: جميع الترتيبات بين الشركات، والقرارات التي تتخذها رابطات الشركات والممارسات المتفاهم عليها التي قد تؤثر على التجارة بين الدول الأعضاء والتي يكون هدفها أو أثرها هو منع أو تقييد أو تشويه المنافسة داخل السوق المشتركة " .

Article 88(1) provides that " save as otherwise provided in this Treaty, any aid granted by a member State or through State resources in any form whatsoever which distorts or threatens to distort competition by favouring certain undertakings or the production of certain goods shall, in so far as it affects trade between member States, be incompatible with the Common Market " .
وتنص المادة 88 (1) على ما يلي " فيما عدا الحالات التي ينص فيها على خلاف ذلك في هذه المعاهدة فإن أي معونة ممنوحة من إحدى الدول الأعضاء أو عن طريق موارد الدولة بأي شكل كان من شأنها أن تشوه أو تهدد بتشويه المنافسة عن طريق تحبيذ مشاريع معينة أو إنتاج سلع معينة تعتبر بقدر ما تؤثر على التجارة بين الدول الأعضاء غير متوافقة مع السوق المشتركة " .
