In that report the Working Group considered that the situation of " provisional " judges and prosecutors was " serious " and it concurred with the Special Rapporteur on the independence of judges and lawyers that " the trial of persons ... by judges without security of tenure constitutes prima facie a violation of the right to be tried by an independent tribunal " (E/CN.4/1998/39/Add.1, para. 106).
