In this regard, they have three essential duties: to respect, protect and fulfil the human rights of individuals or groups within their territory or jurisdiction.
وفي هذا الصدد، يقع على عاتقها تنفيذ ثلاث مهام أساسية هي احترام حقوق الإنسان للأفراد أو الجماعات، وحمايتها، وإعمالها داخل أقاليمها أو ولايتها القانونية.

[States shall not take or appropriate the lands, territories, or resources of indigenous peoples under any circumstances]
[ولا يجوز للدول أن تستولي على أراضي الشعوب الأصلية أو أقاليمها أو مواردها أو أن تصادرها في أي ظرف من الظروف].

(b) Any action which has the aim or effect of dispossessing them of their lands, territories or resources;

159. The view was expressed that the draft articles should maximize the freedom of States to conduct, within their territories or under their jurisdiction or control, activities which were not in themselves unlawful.
159 - أعرب عن رأي آخر مفاده أن مشاريع المواد ينبغي أن تمنح الدول أقصى قدر من الحرية للاضطلاع، داخل أقاليمها أو في إطار ولايتها القضائية أو تحت سيطرتها بأنشطة لا تعتبر غير مشروعة في حد ذاتها.

Finally, article 32 provides in more general terms that States should consult indigenous peoples in order to obtain their free, prior and informed consent prior to the approval of any project affecting their lands, territories or resources.
وأخيراً تنص المادة 32 بألفاظ أكثر عمومية على أنه ينبغي للدول أن تتشاور مع الشعوب الأصلية من أجل الحصول على موافقتها الحرة والمسبقة والمستنيرة قبل إقرار أي مشروع يؤثر على أراضيها أو أقاليمها أو مواردها.

It was correctly recognized that States should be reasonably free to permit desired activities within their territory or under their jurisdiction or control, despite the possibility that they might give rise to transboundary harm; however, it was equally correctly recognized that States should ensure that some form of relief, such as compensation, be made available if actual harm occurred.
واعتُرف عن حق بأنه ينبغي أن تكون للدول حرية السماح بالأنشطة المرغوب فيها داخل أقاليمها أو في الأقاليم الواقعة تحت ولايتها أو سيطرتها على الرغم من إمكانية أن ينشأ عنها ضرر عابر للحدود، ومع ذلك فقد اعترف بحق أيضا بأنه ينبغي للدول أن تكفل توفير شكل من الجبر، مثل التعويض، في حالة وقوع ضرر فعلي.

They should also assure that all investments emanating from their territory or nationals not contribute to the nuclear-related, other weapons of mass destruction-related, or ballistic missile-related programmes of the Democratic People's Republic of Korea.

وينبغي كذلك كفالة ألا تسهم جميع الاستثمارات، الموظفة من أقاليمها أو مواطنيها، في البرامج النووية لجمهورية كوريا الشعبية الديمقراطية أو في غيرها من برامج أسلحة الدمار الشامل أو المتصلة بالقذائف التسيارية.

2. In the present report, it is recalled that States are bound to respect the human rights of all persons in their territory or under their jurisdiction, irrespective of their nationality or lack thereof.
