15- وفي معظم تقارير الدول الأطراف التي درستها اللجنة إلى الآن، جرى الخلط بين مفهومَي القدرة العقلية والأهلية القانونية لدرجة أن الشخص الذي يُعتبر مصاباً بعجز في مهارات اتخاذ القرار، بسبب إعاقة إدراكية أو نفسية اجتماعية في كثير من الأحيان، يُجرَّد نتيجة ذلك من أهليته القانونية في اتخاذ القرار.

13. The Committee is very concerned about the provision in the State party's new Fundamental Law which permits a judge to remove the right to vote from those with " limited mental ability " , and that legislation allows for the right to vote of persons with intellectual or psycho-social disabilities to be restricted if the person concerned has been deprived of his or her legal capacity.
45- تعرب اللجنة عن قلقها البالغ إزاء إدراج نص في القانون الأساسي الجديد للدولة الطرف يسمح للقاضي بسحب حق التصويت من الأشخاص ذوي " القدرة العقلية المحدودة " ، وإزاء التشريعات التي تقيّد حق التصويت للأشخاص ذوي الإعاقات الفكرية أو النفسية والاجتماعية إذا كان الشخص المعني محروماً من أهليته القانونية.

45. An individual may not be deprived of his legal capacity in any circumstances.
٨٣- ولا يجوز حرمان أي شخص من أهليته القانونية أياً كانت الظروف.

Under the Legal Incapacity and Guardianship Act, guardianships covering financial matters may deprive a person of his legal capacity if this is necessary to prevent the person from exposing his or her fortune, income or other financial interests to the dangers of significant depreciation or to prevent financial exploitation.

22- تحث اللجنة الدولة الطرف على اعتماد تدابير لإلغاء القوانين والسياسات والممارسات التي تُجيز الوصاية والقوامة على البالغين واتخاذ إجراءات تشريعية للاستعاضة عن نُظم اتخاذ القرارات بالنيابة عن الغير بنُظم دعم لاتخاذ القرارات تحترم استقلالية الشخص وإرادته وأفضلياته لدى ممارسة أهليته القانونية وفقاً للمادة 12 من الاتفاقية.
