3. The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall specify:
3- تحدِّد الجهةُ المشترية ما يلي عندما تَلتمس لأوَّل مرة مشاركةَ الموَرِّدين أو المقاولين في إجراءات الاشتراء:

A procuring entity shall impose no criterion, requirement or procedure with respect to the qualifications of suppliers or contractors other than those provided for in this Law.
ولا تفرض الجهةُ المشترية أيَّ معيار أو اشتراط أو إجراء آخر يتعلق بمؤهّلات الموَرِّدين أو المقاولين غير ما هو منصوص عليه في هذا القانون.

8. Only suppliers or contractors that have been pre-qualified are entitled to participate further in the procurement proceedings.
8- لا يحقّ الاستمرارُ في المشاركة في إجراءات الاشتراء إلاَّ للموَرِّدين أو المقاولين الذين أُهِّلوا أوَّليًّا.

It shall also make available to any person, upon request, the names of all suppliers or contractors that have been pre-qualified.
وتتيح أيضاً لأيِّ شخص، بناء على الطلب، أسماء جميع المورِّدين أو المقاولين الذين أُهِّلوا أوَّليًّا.

The standstill period shall run from the date of the dispatch of the notice under this paragraph to all suppliers or contractors that presented submissions.
وتسري مدة التوقف ابتداء من تاريخ إرسال الإشعار بمقتضى هذه الفقرة إلى جميع المورِّدين أو المقاولين الذين قدّموا عروضاً.

Prohibition of negotiations with suppliers or contractors
حظر المفاوضات مع المورِّدين أو المقاولين

It shall make available to any person, upon request, the names of all suppliers or contractors that have been pre-selected.
وتتيح لأيِّ شخص، عند الطلب، أسماء جميع المورِّدين أو المقاولين الذين وقع عليهم الاختيار الأولي.

(v) If suppliers or contractors are permitted to present submissions for only a portion of the subject matter of the procurement, a description of the portion or portions for which submissions may be presented;
`5` في حال السماح للمورِّدين أو المقاولين بتقديم عروض بشأن جزء فقط من الشيء موضوع الاشتراء، وصفاً للجزء الذي يجوز تقديمُ عرض بشأنه أو الأجزاء التي يجوز تقديمُ عروض بشأنها؛

وتتيح أيضا لأيّ فرد من الجمهور، بناء على طلب منه، أسماء جميع المورِّدين أو المقاولين الذين أُهِّلوا أوليا.

Article 43. Prohibition of negotiations with suppliers or contractors
المادة 43- حظر المفاوضات مع المورِّدين أو المقاولين

It shall make available to any member of the general public, upon request, the names of all suppliers or contractors that have been preselected.
وتتيح لأي فرد من الجمهور، عند الطلب، أسماء جميع المورِّدين أو المقاولين الذين وقع عليهم الاختيار الأولي.

The price that the procuring entity may charge for the request for proposals shall reflect only the cost of providing it to suppliers or contractors.
ويجب ألاّ يتجاوز الثمن الذي يجوز للجهة المشترية أن تتقاضاه على طلب الاقتراحات تكلفة توفيره للمورِّدين أو المقاولين.

Article 35. Prohibition of negotiations with suppliers or contractors
المادة 35- حظر المفاوضات مع المورِّدين أو المقاولين

Whether grounds and justifications for cancellation must always be provided and, if so, whether they should be provided in the same way as a notice of cancellation or only to suppliers or contractors concerned
ما إذا كان يجب دائما تقديم أسباب الإلغاء ومبرراته، وإذا كان الأمر كذلك فهل ينبغي تقديمها بنفس الطريقة التي وُجِّه به إشعار الإلغاء أم جعلها مقصورة على المورّدين أو المقاولين المعنيين

It was also noted that under the law of some jurisdictions, the procuring entity would in any case have to communicate the grounds to all suppliers or contractors affected by a decision to reject all submissions.
وذُكر أيضا أن قانون بعض الولايات القضائية ينص على أنه يتعين على الجهة المشترية، على أية حال، أن تبلّغ جميع المورّدين أو المقاولين الذين يتضررون بقرار رفض جميع العروض بأسباب ذلك الرفض.

In response, it was explained that the aim of the standstill period was to allow suppliers or contractors sufficient time to decide whether to protest the procuring entity's intended decision to accept the successful submission.
وردا على ذلك، أوضح أن الهدف من فترة التوقف هو إتاحة الوقت الكافي للموردين أو المقاولين للبت فيما إذا كان ينبغي تقديم احتجاج بشأن القرار الذي تعتزم الجهة المشترية اتخاذه بقبول العرض الفائز.

The provisions require sending notification individually to each supplier or contractor concerned.
وتشترط الأحكام إرسال إبلاغ إلى كل واحد من المورِّدين أو المقاولين المعنيين.

Effectively, suppliers or contractors not using the same information systems as the procuring entity would be excluded, with the risk of discrimination among suppliers and contractors, and higher risks of improprieties.
وهذا يؤدّي فعليا إلى استبعاد المورِّدين أو المقاولين الذين لا يستخدمون ذات نظم المعلومات التي تستخدمها الجهة المشترية، مع احتمال التمييز بين المورِّدين والمقاولين، وزيادة احتمالات حدوث تجاوزات.
