2. Predominant nationality was the approach taken in draft article 7 in respect of multiple nationality and claim against a State of nationality. Within the context of the Vienna Convention on Consular Relations, the consular functions of a discretionary nature listed in article 5 of the Convention were triggered by nationality, but so were obligations such as those in article 36 to notify detained persons of certain rights.

In its report on " The Death Penalty in the Inter-American Human Rights System: From Restrictions to Abolition " , the Inter-American Commission on Human Rights has examined issues related to due process concerning the failure to comply with the notification requirements of the Vienna Convention on Consular Relations in the execution of foreign nationals in the United States.
