It came to the conclusion that a new draft article should be included, stating that an injured member of an international organization may not take countermeasures against the organization so long as the rules of the organization provide reasonable means to ensure compliance of the organization with its obligations under Part Two of the draft articles.

57. Mr. Keinan (Israel) said that one of the most controversial aspects of Part Two of the draft articles on State responsibility (A/54/10, chap. V) was the definition of an injured State.

84. The “content, forms and degrees of international responsibility”, as set out in Part Two of the draft articles, do distinguish in certain respects between international crimes and international delicts, as noted above.
