7. With regard to the international arrangements necessary to create a favourable environment for the realization of the right to development, Mr. Pillay cited the anniversary statement of the Committee on Economic, Social and Cultural Rights, which recalled that this right established a specific framework within which the duty to provide international cooperation and assistance had to be implemented.
7- وفيما يتعلق بالترتيبات الدولية اللازمة من أجل خلق بيئة مواتية لإعمال الحق في التنمية، أشار السيد بيلاي إلى بيان الذكرى الصادر عن اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية، والذي يذكّر بأن هذا الحق يرسي إطاراً محدداً يجب أن ينفَّذ من خلاله واجب تقديم التعاون والمساعدة الدوليين.

Even then, various due process protections as outlined in general comment No. 7 of the Committee on Economic, Social and Cultural Rights, must be adhered to.

General comment No. 14 (2000) on the right to health of the Committee on Economic, Social and Cultural Rights elaborates that the State obligation to fulfil this right includes " the provision of a public, private or mixed health insurance system which is affordable for all " (para. 36).

31. According to general comment No. 19 of the Committee on Economic, Social and Cultural Rights, social security is of central importance for guaranteeing a life in dignity for all, when faced with circumstances that affect the full exercise of their Covenant rights.
31- ووفقاً للتعليق العام رقم 19، الصادر عن اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية، يحظى الضمان الاجتماعي بأهمية مركزية في صون الكرامة الإنسانية لجميع الأشخاص، عندما يتعرضون لظروف تؤثر في التمتع الكامل بحقوقهم المنصوص عليها في العهد().

They should pay attention to availability, accessibility, acceptability and adaptability as essential features for assessing the fulfilment of their obligations in the realization of the right to education as detailed in general comment No. 13 (1999) of the Committee on Economic, Social and Cultural Rights on the right to education;

20. General comment No. 14 (2000), of the Committee on Economic, Social and Cultural Rights, on the right to the highest attainable standard of health (art. 12) refers to the nonderogability of core obligations.

51. In this connection, it is important to recall general comment No. 9 (1998) of the Committee on Economic, Social and Cultural Rights on the domestic application of the Covenant which states that: " It is sometimes suggested that matters involving the allocation of resources should be left to the political authorities rather than the courts.
51- وفي هذا الصدد، من المهم الإشارة إلى التعليق العام رقم 9(1998) الصادر عن اللجنة المعنية للحقوق الاقتصادية والاجتماعية والثقافية بشأن تطبيق العهد على الصعيد المحلي إذ صرحت " بأنه يقترح أحياناً ترك أمر البت في المسائل المتعلقة بتوزيع الموارد للسلطات السياسية بدلاً من تركه للمحاكم.

The implementation of the critical area of concern on the economy should reflect international human rights standards, requiring that economic policies ensure non-discrimination and equality, and non-retrogression in the realization of economic and social rights, including women's access to decent work (see E/2005/22, annex X, general comment No. 18 of the Committee on Economic, Social and Cultural Rights).

8. The obligations of States to respect, protect and fulfil the rights enshrined in the International Covenant on Economic, Social and Cultural Rights are spelt out in article 2, paragraph 1, of the Covenant and further clarified in general comment No. 3 (1990) of the Committee on Economic, Social and Cultural Rights on the nature of States parties' obligations.
8- وترد التزامات الدول باحترام وحماية وإنفاذ الحقوق المجسدة في العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية() في الفقرة 1 من المادة 2 من العهد، وتم توضيحها إلى حد أكبر في التعليق العام رقم 3(1990) الصادر عن اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية بشأن طبيعة التزامات الدول الأطراف.

28. General comment No. 14 of the Committee on Economic, Social and Cultural Rights also notes that " States are under the obligation to respect the right to health by, inter alia, refraining from denying or limiting equal access for all persons, including prisoners or detainees, minorities, asylum-seekers and illegal immigrants, to preventive, curative and palliative health services " .
28- ويشير أيضاً التعليق العام رقم 14 الصادر عن اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية إلى أن " الدول ملزمة باحترام الحق في الصحة عن طريق جملة أمور منها عدم منع أو تقييد إتاحة فرص متكافئة لجميع الأشخاص بمن فيهم السجناء أو المحتجزون أو الأقليات أو ملتمسو اللجوء والمهاجرون غير الشرعيين للحصول على الخدمات الصحية الوقائية والعلاجية والمسكنة " ().

3.2 The petitioner refers to general comment No. 19 (2007) of the Committee on Economic, Social and Cultural Rights on the right to social security, where it is stated that differences in the average life expectancy of men and women can also lead directly or indirectly to discrimination in provision of benefits (particularly in the case of pensions) and thus need to be taken into account in the design of the scheme.
