36. Article 2 of the draft articles on the responsibility of States specifies the meaning of an internationally wrongful act, stating its two basic elements: attribution of conduct to a State and characterization of that conduct as a breach of an international obligation.

It is however understood that, should such an issue nevertheless arise in respect of an international organization, one would have to apply the pertinent rule which is applicable to States by analogy to that organization, either article 9 or article 10 of draft articles on Responsibility of States for internationally wrongful acts.
