5.3 As to the State party's reference to the independent medical assessments of the main complainant and his wife, the complainants point out that these assessments are of no relevance.

5.2 As to the State party's reference to the complaint procedure of the Human Rights Council, the authors submit that neither the Global Initiative for Economic, Social and Cultural Rights nor the Equal Opportunities Association has had recourse to this procedure in the present communication.

9.3 Finally, with regard to the State party's reference to the availability of legal advice from Community Legal Centres, Mr. Barbaro submits that " such assistance is only available in extreme situations and ... only of the matter involves an indictable offence " .
٩-٣ وأخيرا، ففيما يتعلق بإشارة الدولة الطرف إلى توافر المشورة القانونية من المراكز القانونية المجتمعية، يدفع السيد بربارو بقوله إن " هذه المساعدة لا تتوفر إلا في الحالات القصوى ... - فقط إذا كان اﻷمر ينطوي على جريمة جنائية خطيرة.

As to the State party's reference to the criteria set out in the Committee's general comment No. 1, she notes that the criterion in paragraph 8 (c) refers not only to whether there exists independent proof of torture -- as outlined by the State party -- but also to whether the torture had any after-effects.

The Committee further takes note of the State party's reference to the concept of jurisdiction in public international law, in addition to its contention that the Convention lacks extraterritorial effect and that, unlike other human rights treaties, does not deal, directly or indirectly, with removal to torture or other serious threats to life and the security of a person.
وتحيط اللجنة علماً كذلك بإشارة الدولة الطرف إلى مفهوم الولاية في القانون الدولي العام، بالإضافة إلى إدعائها أن الاتفاقية ليس لها أثر يتجاوز الإقليم وأنها لا تتناول، لا بشكل مباشر ولا غير مباشر، بخلاف المعاهدات الأخرى لحقوق الإنسان، ترحيل شخص إلى مكان قد يتعرض فيه للتعذيب أو لمخاطر جسيمة أخرى على حياته وأمنه.

50. The Committee welcomes the State party's indication that the consideration of cases involving unaccompanied asylum-seekers shall be prioritized.
