On 7 March 2006, the indictment division of the Algiers court issued a decision terminating criminal proceedings against Mr. Benyamina and ordering his release, in application of articles 4 to 11 of Order No. 06/01 of 27 February 2006 implementing the Charter for Peace and National Reconciliation.
13- وفي 7 آذار/مارس 2006، أصدرت دائرة الاتهام في محكمة الجزائر أمراً يقضي بسقوط الدعوى العامة المقامة على السيد محمد بنيامينة وأمرت بإطلاق سراحه تطبيقاً للمواد 4 إلى 11 من القرار رقم 06/01 الصادر في 27 شباط/فبراير 2006 المتعلق بتنفيذ ميثاق السلم والمصالحة الوطنية.

Furthermore, and bearing in mind that the Procurator-General's application was prejudicial to Mr. Benyamina and Mr. Ikhlef, the principle of equality of arms between the prosecution and the defence was seriously undermined. This constitutes a violation of article 14 of the International Covenant on Civil and Political Rights, to which Algeria is a party.
وعلاوة على ذلك، وباعتبار أن طلب المدعي العام ألحق الضرر بالسيد بنيامينة وبالسيد يخلف، فإن مبدأ تكافؤ الوسائل بين الادعاء والدفاع قد تضرَّر بشكل كبير وهو ما يشكل انتهاكاً للمادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية الذي انضمت إليه الجزائر كدولة طرف.

The deprivation of liberty of Mr. M'hamed Benyamina and Mr. Mourad Ikhlef is arbitrary, being in contravention of article 14 of the International Covenant on Civil and Political Rights, and falls within category III of the categories applicable to the consideration of the cases submitted to the Working Group.

12. According to the Government's observations, on 6 February 2006 Mr. M'hamed Benyamina was placed in pretrial detention by the examining magistrate of the second chamber of the Sidi M'hamed court in Aligers; he was charged with membership of a terrorist organization active in Algeria and abroad.
12- وحسب ملاحظات الحكومة، " وُضع السيد محمد بنيامينة في 6 شباط/فبراير 2006 رهن الاحتجاز الاحتياطي بأمر من قاضي التحقيق التابع للدائرة الثانية في محكمة الجزائر/سيدي محمد بتهمة الانتماء إلى منظمة إرهابية تنشط في الجزائر وفي الخارج.

16. It should be noted that Mr. Benyamina was the subject of an international letter rogatory issued by the Italian judicial authorities on 18 April 2006, relating to two investigations under way in Italy involving charges of membership of a terrorist organization; Mr. Benyamina is implicated in those investigations.
16- وتجدر الإشارة إلى أن السيد بنيامينة كان موضوع تفويض التماسي دولي نابع من السلطات القضائية الإيطالية في 18 نيسان/أبريل 2006 في إطار تحقيقين قضائيين فُتحا في إيطاليا بشأن تهم الانتماء إلى منظمة إرهابية كان محمد بنيامينة متورطاً فيها.

23. In response to the communication sent by the Government on 15 August 2006, the source raised two important points: first, the Government failed to address the question of the legality of Mr. Benyamina's detention during his five months of imprisonment, which was not authorized by a court decision, on DRS premises.
23- وردّاً على رسالة الحكومة المؤرخة 15 آب/أغسطس 2006، أثار المصدر نقطتين هامتين هما: أولاً، أغفلت الحكومة شرعية حبْس السيد بنيامينة في مقر إدارة الاستخبارات والأمن لمدة خمسة أشهر دون وجود مبرر على شكل قرار قضائي.

27. Having concluded that such a violation took place, the Working Group did not deem it necessary to consider the other allegations put forward by the source, in particular those relating to the illegality of Mr. Benyamina's five months of detention by DRS.
27- وإذ استنتج الفريق العامل حدوث هذا الانتهاك، فإنه لم ير ضرورةً لفحص الادعاءات الأخرى التي قدمها المصدر وخاصةً منها تلك المتعلقة باحتجاز السيد بنيامينة بصورة غير قانونية لمدة خمسة أشهر في مقر إدارة الاستخبارات والأمن.
