The Committee reiterates its concern about the absence of a definition of racial discrimination in domestic law that is in full compliance with the Convention definition, even if the provisions of the Convention may be directly invoked before national courts, and also its concern for sufficient clarity on the relationship between the Convention and domestic law.

22. CERD encouraged Togo to include in its legislation a definition of racial discrimination in line with the Convention and recommended that the Government's activities, including the activities of the Office of the High Commissioner for Reconciliation and Strengthening National Unity, take into account the principle of non-discrimination.

Notwithstanding the assurances provided by the State party concerning the direct applicability of article 1 of the Convention pursuant to the provision of article 12, paragraph 3, of the Constitution, the Committee notes the absence of a definition of racial discrimination in the law of the State party (art. 1).
