77. In a number of cases, the Committee on the Elimination of Racial Discrimination found a violation of article 6 of CERD, relating to the duty of States to assure effective protection and remedies, and the right to seek adequate reparation or compensation.

453. The Committee noted with concern that the State party did not provide information on the implementation of article 6 of the Convention, on effective protection and remedies and on the right to seek just and adequate reparation or satisfaction.
٤٥٣ - ولاحظت اللجنة مع القلق أن الدولة الطرف لم تقدم معلومات عن تنفيذ المادة ٦ من الاتفاقية بشأن الحماية الفعﱠالة ووسائل الانتصاف، وبشأن الحق في طلب جبر أو تعويض عادل ومناسب.

579. With respect to article 6 of the Convention, concern is expressed over the lack of legislative provisions to implement the right to just and adequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination.
٥٧٩ - وفيما يتعلق بالمادة ٦ من الاتفاقية، يُعرب عن القلق للافتقار إلى أحكام تشريعية متعلقة بتنفيذ الحق في التماس جبر أو تعويض عادل مناسب عن أي ضرر يلحق نتيجة للتمييز العنصري.

To ensure that everyone within a State's jurisdiction, including victims of racism, racial discrimination, xenophobia and related intolerance, enjoys access to justice, as well as to appropriate State institutions and mechanisms in order to seek recognition of wrong-doing and just, fair and adequate reparation or satisfaction for any damage suffered.
ضمان إمكانية وصول جميع الأشخاص داخل ولاية الدولة القضائية، بمن فيهم ضحايا العنصرية والتمييز العنصري وكره الأجانب وما يتصل بذلك من تعصب، إلى العدالة وكذا الوصول إلى المؤسسات والآليات الملائمة التابعة للدولة من أجل الحصول على اعتراف بالجرم، وعلى جبر أو ترضية عادلة ومنصفة وكافية تعويضاً عن أي ضرر.

The Committee also recommends that the State party intensify its efforts to ensure to everyone within its jurisdiction effective protection against any act of racial discrimination, as well as the right to seek just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination.
كما توصي اللجنة الدولة الطرف بتكثيف جهودها لضمان الحماية الفعلية لكل فرد مشمول بولايتها القضائية من أي فعل من أفعال التمييز العنصري، وكذلك ضمان الحق في التماس جبر أو تعويض عادل وكاف عن أي ضرر يقع نتيجة هذا التمييز.

193. Urge States to adopt the necessary measures to ensure the rights of victims, in particular the right to an effective judicial remedy and to seek just and adequate reparation or satisfaction for acts of racism, racial discrimination, xenophobia and related intolerance, and effective measures designed to prevent the resurgence of such acts;
193- نحث الدول على اتخاذ التدابير اللازمة لضمان حقوق الضحايا، ولا سيما الحق في الانتصاف القضائي الفعال والتماس جبر أو ترضية عادلة وكافية عن أعمال العنصرية والتمييز العنصري وكره الأجانب وما يتصل بذلك من تعصب، واتخاذ تدابير فعالة لمنع تكرار هذه الأعمال؛

9. To reinforce protection against racism, racial discrimination, xenophobia and related intolerance, the European Conference calls upon participating States to ensure that all persons have access to effective and adequate remedies and enjoy the right to seek from competent tribunals just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination.
9- وتعزيزاً للحماية من العنصرية والتمييز العنصري وكره الأجانب وما يتصل بذلك من تعصب، يدعو المؤتمر الأوروبي الدول المشاركة إلى ضمان وصول جميع الأشخاص إلى سبل الانتصاف الفعالة والكافية والتمتع بالحق في اللجوء إلى المحاكم المختصة للحصول على ما هو عادل وكاف من جبر أو تعويض عن أي ضرر لحق بهم نتيجة لهذا التمييز.

The Committee also notes with concern that the alleged insufficient will of federal and state authorities to take action with regard to such violence and abuse often deprives victims belonging to racial, ethnic and national minorities, and in particular Native American women, of their right to access to justice and the right to obtain adequate reparation or satisfaction for damages suffered (arts. 5 (b) and 6).
وتلاحظ اللجنة أيضاً بقلق ما يقال من عدم توافر إرادة كافية لدى السلطات الاتحادية وسلطات الولايات لاتخاذ إجراءات لمكافحة أفعال العنف والاعتداء هذه وما يؤدي إليه ذلك في أحيان كثيرة من حرمان الضحايا المنتميات إلى الأقليات العرقية والإثنية والقومية، وبخاصة نساء السكان الأمريكيين الأصليين، من حقهن في عرض قضاياهن على القضاء والحصول على جبر أو تعويض مناسب عما لحق بهن من أضرار (المادتان 5(ب) و6).

In addition, the Committee is concerned that crossborder trafficking in persons continues to be a serious problem in the State party, facilitated by the extensive use of entertainment visas issued by the Government, and that support measures for identified victims remain inadequate, leading to victims of trafficking being treated as illegal immigrants and deported without redress or remedy.
