With good reason, the drafters of the Convention against Torture included " whether physical or mental " into the definition of torture.
ولأسباب سليمة أدرج واضعو اتفاقية مناهضة التعذيب عبارة " جسدياً كان أم عقلياً " في تعريف التعذيب.

Article 263 bis: Torture is defined as any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for any purpose whatsoever.
المادة 263 مكرراً: يُقصد بالتعذيب كل عمل ينتج عنه عذاب أو ألم شديد جسدياً كان أو عقلياً يُلحق عمداً بشخص ما، مهما كان سببه.

His Government noted that the definition of torture did not include the word " suffering " but, in its view, the expression " causes severe pain whether physical or mental " would necessarily include any suffering caused to any person.

According to the definition contained in the Convention against Torture, four elements are needed in order for an act to be qualified as torture: firstly, an act inflicting severe pain or suffering, whether physical or mental; secondly, the element of intent; thirdly, the specific purpose; and lastly, the involvement of a State official, at least by acquiescence.

The State party submits that to be classified as torture, the given conduct must inflict " severe pain or suffering, whether physical or mental " .

It restricts acts of torture to " any act which causes severe pain, whether physical or mental " , while the Convention definition refers to " severe pain or suffering " .

However, she wondered about the definition of torture in the Senegalese Penal Code and whether its scope was as broad as that of article 1 of the Convention, under which “torture” meant “any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person”, a definition which was to be read in conjunction with article 7 of the Covenant.

At least four essential elements are reflected in the definition of torture provided in article 1, paragraph 1, of the Convention against Torture: an act inflicting severe pain or suffering, whether physical or mental; the element of intent; the specific purpose; and the involvement of a State official, at least by acquiescence (A/HRC/13/39/Add.5, para. 30).

The Convention states: " the term `torture'means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person ... for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity " .
حيث تنص الاتفاقية على: " يقصد " بالتعذيب " أي عمل ينتج عنه آلم أو عذاب شديد، جسدياً كان أم عقلياً، يلحق عمداً بشخص ما ... لأي سبب من الأسباب يقوم على التمييز أياً كان نوعه، عندما يُلحق مثل هذا الألم أو العذاب أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية " .

In accordance with the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the term “torture” meant any act by which severe pain or suffering, whether physical or mental, was intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him or intimidating him, by a public official or other person acting in an official capacity.
إذ يقصد " بالتعذيب " في اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة " أي عمل ينتج عنه ألم أو عذاب شديد، جسدياً كان أم عقلياً، يلحق بشخص ما بقصد الحصول من هذا الشخص أو من شخص ثالث على معلومات أو على اعتراف، أو معاقبته ... أو تخويفه ... من طرف موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية " .
