8. The Secretariat received a communication in accordance with article 3 of the Basel Convention, dated 31 January 2004, from Malaysia, conveying its national definition of hazardous wastes, other than those listed in Annexes I and II of the Convention, considered or defined as hazardous under its national legislation and requirements concerning transboundary movement procedures applicable to such wastes.
8 - تلقت الأمانة إخطاراً من ماليزيا وفقاً للمادة 3 من اتفاقية بازل، بتاريخ 31 كانون الثاني/يناير 2004، تنقل فيه تعريفها الوطني للنفايات الخطرة خلاف النفايات المدرجة في المرفقين الأول والثاني من الاتفاقية، التي تعتبر خطرة أو تُعرف على أنها خطرة بموجب تشريعاتها الوطنية وشروطها فيما يتعلق بإجراءات النقل عبر الحدود المطبقة على هذه النفايات.

Each Party listed in Annex VII shall phase out by 31 December 1997, and prohibit as of that date, all transboundary movements of hazardous wastes under Article 1 (1)(a) of the Convention which are destined for operations according to Annex IV B to States not listed in Annex VII. Such transboundary movements shall not be prohibited unless the wastes in question are characterised as hazardous under the Convention. "
2 - يتخلص كل طرف من الأطراف المدرجة في المرفق السابع نهائياً في موعد لا يتجاوز 31 كانون الأول/ديسمبر 1997، ويحظر بدءاً من هذا التاريخ كل عمليات النقل عبر الحدود للنفايات الخطرة بموجب المادة 1 (1) (أ) من الاتفاقية بغرض القيام بعمليات مدرجة في المرفق باء، إلى دول غير مدرجة في المرفق السابع. ولا يحظر هذا النقل عبر الحدود ما لم توصف النفايات المعنية بأنها خطرة بموجب الاتفاقية.

" `2.
