7.5 The Committee observes that the State party's obligation to refrain from forcibly returning a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture is directly linked to the definition of torture as found in article 1 of the Convention.

5. Also urges States not to expel, return (refouler), extradite or in any other way transfer a person to another State where there are substantial grounds for believing that the person would be in danger of being subjected to torture;

8.2 The Committee must determine whether, in deporting the complainant to Haiti, the State party failed in its obligation under article 3 of the Convention not to expel or return (refouler) a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.

Article 3 of the Convention against Torture provides that a person shall not be expelled " to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture " .
