Article 16 - Equality in all matters relating to marriage and the raising of children

1. States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family, parenthood and relationships, on an equal basis with others, so as to ensure that:
1 - تتخذ الدول الأطراف تدابير فعالة ومناسبة للقضاء على التمييز ضد المعوقين على قدم المساواة مع الآخرين في جميع المسائل ذات الصلة بالزواج والعلاقات الأسرية والشخصية وذلك من أجل:

33. The Committee urges the State party to accelerate the establishment of a family court with the authority to deal with all matters relating to marriage and its dissolution, within a concrete time frame.
33 - وتحث اللجنة الدولة الطرف على الإسراع بإنشاء محكمة للأسرة وتخويلها سلطة معالجة جميع القضايا ذات الصلة بالزواج وفسخه في إطار زمني محدد.

43. The Committee is deeply concerned about the high prevalence of discriminatory legal provisions and negative customary practices related to marriage and family relations, which reflects the lack of advancement of the status of women in the society.

The Committee notes with concern that, although legislation guarantees women equal rights with men in matters relating to marriage and family relations, in practice, discrimination against women remains widespread in those areas and can be seen, inter alia, in the persistence of unregistered religious marriages.
128 - وتـلاحـظ اللجنـة مع القلق أنـه بالرغم من أن التشريعـات تكفل المساواة في الحقوق بيــن النساء والرجال في المسائل ذات الصلة بالزواج والعلاقات الأسرية، لا يزال التميـيز ضد المرأة قائما ومنتشـرا على نطاق واسـع، من حيث الممارسة، في هذيـن المجالين، ويمكـن مشاهدتـه، ضمـن جملة أمـور أخرى، في استمرار الزيجـات الدينيـة غير المسجـلة.

29 - وتـلاحـظ اللجنـة مع القلق أنـه بالرغم من أن التشريعـات تكفل المساواة في الحقوق بيــن النساء والرجال في المسائل ذات الصلة بالزواج والعلاقات الأسرية، لا يزال التميـيز ضد المرأة قائما ومنتشـرا على نطاق واسـع، من حيث الممارسة، في هذيـن المجالين، ويمكـن مشاهدتـه، ضمـن جملة أمـور أخرى، في استمرار الزيجـات الدينيـة غير المسجـلة.

(c) The revised provisions (Ordinance No. 05-02 of 27 February 2005) of the Family Code (Code de la famille), which stipulate issues related to marriage and family life, including child custody.
