Roberto Ago acknowledged that undue delay might lead to the conclusion that local remedies were ineffective, but failed to propose this as a special exception in the local remedies rule in article 22.

In a memorandum dated 1 June 1995 (S/1995/448), the Secretary-General had described the steps to be taken in accordance with Article 14 of the Statute of the International Court of Justice in order to fill the vacancy that had occurred in the Court as a result of the death, on 24 February 1995, of Judge Roberto Ago (Italy).

The distinction between primary and secondary rules was invoked by Special Rapporteur Roberto Ago as a tool for rescuing the Commission from the difficulties caused by Special Rapporteur García Amador's proposals to codify the international minimum standard in his draft articles on State responsibility.

During the week ending 11 March 1995, pursuant to a note by the Secretary-General dated 6 March 1995 (S/1995/178) and in accordance with the understanding reached in its prior consultations, the Security Council met at its 3507th meeting, held on 9 March 1995, to consider the date of an election to fill a vacancy in the International Court of Justice as a result of the death of Judge Roberto Ago (Italy).
