4-2 وفيما يتعلق بالمقبولية، تدفع الدولة الطرف بأن السيدة آدوهان لم تقدِّم أي شكوى أو طلب عن طريق المحاكم باسمها وبالتالي فإنها لم تستنفد سبل الانتصاف المحلية في هذا الصدد.

The State party adds that the allegations relating to article 9, paragraph 4, could be deemed an abuse of the right of submission and that, in any event, the author failed to exhaust domestic remedies in this respect, as he did not test the lawfulness of his detention.

4.1 By submission of 23 March 2004, the State party argues that the claim under article 14 of the Covenant is inadmissible because the author has not raised this issue in the domestic proceedings and thus failed to exhaust domestic remedies in this respect.

4.6 As regards the authors' claim under article 17 of the Covenant, the State party contends that the authors have not exhausted domestic remedies in this respect, since they did not argue before the Dutch authorities that the refusal to have their surnames changed constituted an unlawful or arbitrary interference with their privacy.
٤-٦ وفيما يتعلق بادعاء صاحبي البلاغ في اطار المادة ٧١ من العهد، ترى الدولة الطرف أن صاحبي البلاغ لم يستنفدا سبل الانتصاف المحلية في هذا الصدد، حيث أنهما لم يدفعا أمام السلطات الهولندية بأن رفض تغيير لقبيهما يشكل تدخلاً غير قانوني أو تعسفي في حياتهما الخاصة.

The State party argues that the author did not exhaust domestic remedies in this respect and that he could have filed an application for judicial review of this allegation under the ADJR.

4.6 As regards the authors' claim under article 17 of the Covenant, the State party contends that the authors have not exhausted domestic remedies in this respect, since they did not argue before the Dutch authorities that the refusal to have their surnames changed constituted an unlawful or arbitrary interference with their privacy.
٤-٦ وفيما يتعلق بادعاء مقدمي البلاغ في إطار المادة ٧١ من العهد، ترى الدولة الطرف أن مقدمي البلاغ لم يستنفدا سبل الانتصاف المحلية في هذا الصدد، حيث أنهما لم يدفعا أمام السلطات الهولندية بأن رفض تغيير لقبيهما يشكل تدخلا غير قانوني أو تعسفيا في حياتهما الخاصة.

6.1 By a further submission, dated 9 October 1996, the State party acknowledges that the authors, although they have not invoked the specific articles of the Covenant, did in fact raise the substance of the rights protected by articles 2, 3, 14, 23 and 26 before the Courts and that domestic remedies in this respect have thus been exhausted.

6.5 As to the State party's claim that the authors failed to exhaust domestic remedies in relation to his claim of prohibited discrimination, the Committee recalls that the authors did not invoke the specific issue of discrimination before the Czech courts; accordingly, they have not exhausted domestic remedies in this respect.
