The clause “without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms” is not understood by such Governments to restrict the scope of the Commission’s jurisdiction.
أما عبارة " دون المساس بديونه والتزاماته الناشئة قبل ٢ آب/أغسطس ٠٩٩١ والتي سيجري تناولها عن طريق اﻵليات العادية " فلا تفهم منها تلك الحكومات أنها تقيد نطاق اختصاص اللجنة.

The meaning of the clause depends in large part on the interpretation to be given to two phrases contained in the paragraph: the first is the phrase “without prejudice” and the second “which will be addressed through the normal mechanisms”.
٨٥- إن معنى هذا الشرط يتوقف إلى حد كبير على التفسير الواجب إعطاؤه لعبارتين واردتين في الفقرة: أولهما " دون المساس " والثانية " والتي سيجري تناولها عن طريق اﻵليات العادية " .

and “which will be addressed through the normal mechanisms”.The Arabic text uses the phrase “walati syajri”, which can be translated as “which will”, and suggests, as does the English text, the imperative.
فبدراسة هذه النصوص الرسمية اﻷخرى، يجد الفريق أنها تؤكد فعلاً التفسير المقدم أعلاه لعبارتي " دون المساس " )٥١( و " التي سيجري تناولها عن طريق اﻵليات العادية " )٦١(.

As noted by the Panel in paragraph above, in paragraph 16 of resolution 687 (1991), the Security Council reaffirmed that Iraq was liable for any direct loss, damage or injury resulting from its invasion and occupation of Kuwait " without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms " .

The Panel concludes therefore that the ordinary meaning of the phrases “without prejudice” and “which will be addressed through the normal mechanisms” indicate that in using this language the Security Council intended to exclude from the jurisdiction of the Commission “debts and obligations of Iraq arising prior to 2 August 1990”.
٢٦- وعليه، يخلص الفريق إلى أن المعنى العادي لعبارتي " دون المساس " و " التي سيجري تناولها عن طريق اﻵليات العادية " تبينان أن مجلس اﻷمن، باستخدامه هذه الصيغة، قد نوى أن يستثني من ولاية اللجنة ديون العراق والتزاماته " الناشئة قبل ٢ آب/أغسطس ٢٩٩١ " .
