The author further submits that asylum proceedings, in which the investigation conducted by Dutch authorities in Armenia played an important role, have been exhausted which, by itself, is enough for admissibility of the communication.
وتزعم صاحبة البلاغ كذلك أن إجراءات اللجوء التي تشكل التحقيقات التي أجرتها السلطات الهولندية في أرمينيا عنصراً هاماً فيها قد استُنفدت، وهو ما يكفي في حد ذاته لاعتبار البلاغ مقبولاً.

The author further notes that the applicable Dutch immigration law is organized in a manner which allows a strict division between asylum procedures and other immigration procedures.
وتشير صاحبة البلاغ كذلك إلى أن قانون الهجرة الساري في هولندا منظّم بشكل يتيح الفصل الصارم بين إجراءات اللجوء وغيرها من الإجراءات المتعلقة بالهجرة.

The author further maintains that the refusal to renew her temporary work permit and the fact that she was barred from requesting a new one have done her great harm.

The author also failed to file a civil claim against the police or request a criminal prosecution.

The author further claims that the State party's contention that she did not complain about her son's tortures is groundless.
وادعت صاحبة البلاغ كذلك أن حجة الدولة الطرف القائلة بأنها لم تتظلّم من تعرض ابنها للتعذيب حجة واهية.

The author further argues that, when she testified, the entire communication process between her and the interpreters was not reflected in the transcript and the court did not take measures to ensure the accuracy thereof.

The author also contacted several other human rights organizations at various dates, but none were able to assist her.

The author also claimed that the State party denied her husband the right to challenge the lawfulness of his detention.

The petitioner further claims that the State party has previously recognised that the case based on the same crime directed against ethnic Russians in the Baltic countries may be initiated in the interest of the ethnic Russians living in the Russian Federation and, thus, discriminated ethnic Roma against ethnic Russians in the enjoyment of the right to a court and to ethnic identity, in violation of article 5 of the Convention.

3.3 The author furthermore claims that the family of the victim never received appropriate compensation for his death.

The author has also approached the National Human Rights Commission and the Malego Commission, but without success.

The author of the communication also considers that her son's disappearance constituted and continues to constitute for herself and the rest of her family a paralysing, painful and distressing experience given that they know nothing of his fate or, if he is in fact dead, of the circumstances of his death and where he is buried.
